Mr. Lalit Samant, learned counsel for the petitioner. 2. Mr. R.C. Joshi, learned Brief Holder for the State of Uttarakhand. 3. Petitioner was appointed as Group ‘D’ employee in a school run by Basic Education Board, in the year 2003. The employees of Basic Education Board were conferred status of Government Servant in 2006 in terms of provisions contained in Section 58 of Uttarakhand School Education Act, 2006. 4. Since the services rendered by petitioner in a school run by Basic Education Board are not being counted for ACP & other benefits, therefore, she has approached this Court seeking the following reliefs:- (i) Issue a writ order or direction in the nature of mandamus directing to the respondent no. 1 to provide benefit of A.C.P., after counting serviced of the petitioner rendered in Basic Education Board. (ii) Issue a writ order or direction in the nature of mandamus directing to the respondent no. 1 to decide representation dated 08.10.2025 (contained as Annexure no. 6 to the writ petition) of the petitioner within stipulated time framed by Hon’ble High Court. 5. Learned counsel for the petitioner refers to the document enclosed as annexure 6 to the writ petition, which is 2026:UHC:1216 a representation made by her to Director, Elementary Education. Learned counsel for the petitioner submits that Director be directed to take decision on the representation. 6. Learned State Counsel submits that he has no objection, if the writ petition is disposed of in terms of prayer made by petitioner’s counsel. 7. Accordingly, the writ petition is disposed of by directing the Director, Elementary Education to take decision on petitioner’s representation dated 08.10.2025, as per law, within three months from the date of presentation of certified copy of this order.
