Ajaya Swain …. Petitioner(s)
Mr. Jyotirmaya Sahoo, Advocate -versus- State of Odisha …. Opposite Party(s)
Mr. Jateswar Naik, AGA
CORAM: JUSTICE SIBO SANKAR MISHRA
Order No.
ORDER 29.04.2026
01.
1. Heard.
2. The petitioner is seeking pre-arrest bail in connection with Nachuni P.S. Case No.182 of 2025 corresponding to G.R. Case No.421 of 2025 registered on the allegation of the commission of offences under Sections 333/296/126(2)/118(1)/109(1) of B.N.S., 2023 pending in the Court of the learned J.M.F.C., Chilika.
3.
Learned counsel for the petitioner, on instruction from the petitioner, submits that, except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R.
4. On 30.06.2025, the informant lodged a written report before the IIC, Nachuni P.S., alleging that there was a land dispute between him and his nephew. On the same day, at about 9:00 A.M., the petitioner allegedly trespassed into his house and abused his daughter-in-law in filthy language. At that time, the informant returned home from the field. Upon seeing the informant, the petitioner allegedly dealt a blow with a sword on his head with the intention to kill him. However, the informant raised his right hand in an attempt to ward off the attack, as a result of which he sustained a grievous bleeding injury on his right hand. Hence, the case.
5. Mr. Sahoo, learned counsel for the petitioner, during the course of hearing, has placed on record the injury report, which indicates that the injured/informant sustained a cut injury on the palm, appearing to be simple in nature.. He further submits that except the present case, the petitioner has no criminal antecedent and he has mentioned the same in paragraph-4 of the bail application.
6. Regard being had to the nature of allegation and the fact that the injured has sustained simple injury, I am inclined to grant the petitioner anticipatory bail. Accordingly, it is directed that in the event the petitioner is arrested, he shall be released by the Arresting Officer, subject to the verification of the criminal antecedents of similar nature. The release of the petitioner shall also be subject to further verification of the grievousness of the injury. Violation of any of the conditions shall entail cancellation of bail.
7. With this observation, the ABLAPL is disposed of.
