G.P. for Registration and Stamps The Court made the following: 2 W.P.No.30667 of 2024 ORDER: The writ petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus or any other appropriate writ, order or direction, declaring the action of the respondent No. 3 in registering the cancellation deed No.5095 / 2024, dated 13.12.2024 unilaterally revoking the gift settlement deed No.2206 / 2020, dated 28.07.2020, as illegal, arbitrary, violative of the principles of natural justice and Rule 26 (k)(i) of the Andhra Pradesh Rules under the Registration Act, 1908, and contrary to the ratio laid down by the Supreme Court in Thota Ganga Lakshmi Vs. Government of Andhra Pradesh, reported in 2010 (15) SCC 207 and consequently, set aside the cancellation deed No.5095 / 2024, dated 13.12.2024 registered on the file of the respondent No. 3 and pass such other order as this Court deems fit. 2. Sri G. Divyatheja, learned Assistant Government Pleader for Revenue, is present. 3. The learned counsel for the petitioner sought permission of this Court to withdraw the writ petition and filed a memo dated 07.08.2026 stating that subsequent to filing of the writ petition, the impugned cancellation deed had been withdrawn by the donor by executing cancellation of the revocation deed in favour of the petitioner, vide document No. 4732 / 2026, dated 31.07.2026. 4. Accordingly, the writ petition is dismissed as withdrawn. No costs.
