This is the First bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No. 437/2025 registered at Police Station Sarangarh, District- Sarangarh-Bilaigarh (C.G.), for the offence punishable under Sections 20-B of Narcotic Drugs and Psychotropic Substances Act. 2. Case of the prosecution, in brief, is that, on the date of incident i.e. on 28.08.2025, when thana in-charge was engaged in checking, tried VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.02.05 17:43:27 +0530 2 to stop one four wheeler vehicle and one container but they didn't stop and try to escape from the place of incident. Apart from the applicant another man namely Narayan Prashad Sahu and a woman Smt. Sanjana Sahu were sitting in Black Mahindra Four wheeler No. OD 02 AE 1444 and the driver of the container Vehicle No. HR 46-E- 2249 was Devendra Sharma. Upon checking the container vehicle 29 packets of Narcotic Substance Ganja was found when weighted total 91 Kg 320 grams of Ganja recovered from the Container. The applicant is accused of piloting the container Vehicle. On the basis of above seizure the applicant and other accused person were arrested and charge sheet filed. Police registered offence under sec 20 B of NDPS. 3. Learned counsel for the applicant states that applicant is innocent and falsely implicated in the present case. It is further submits that there is no material to show that the applicant was carrying or possessing or transporting ganja and mandatory provision of Section 42 and Section 50 of the NDPS Act has not been complied by prosecution agency. It is further contended that applicant is in jail and trial may take some time for it’s conclusion, therefore, he prays for grant of bail to the applicant. 4. On the other hand learned counsel for the State would oppose the bail application of the applicant and submits that charge-sheet has been filed in the present case and contraband article i.e. 91 Kg 320 grams of Ganja has been recovered from the applicant and co- accused person, therefore, he is not entitled for grant of bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 3 6. From perusal of the case diary, it transpires that the article which has been seized from the possession of the applicants i.e,. 91 kg 320 grams of Ganja, which is far more than commercial quantities, further the applicant has failed to give explanation for the same and it cannot be a case of false implication, the trial is in progress. 7. Accordingly, the second bail application of the applicant – Ranjit Sahu, filed under Section 439 of the Cr.P.C., involved in Crime No. 437/2025 registered at Police Station Sarangarh, District- Sarangarh-Bilaigarh (C.G.), for the offence punishable under Sections 20-B of Narcotic Drugs and Psychotropic Substances Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
