The above Petition was adjourned on the last date by this Hon'ble Court to await Judgment of the Hon'ble Karnataka Electricity Regulatory Commission in Petition bearing O.P. No.14/2022 from which W.P. 9099/2022 and in turn the above Petition arose. 2. On 02.05.2023, the said O.P. 14/2022 was dismissed by the Hon'ble Commission in the following terms: a. The petitioner is not entitled to inject energy beyond 31.05.2023 and the respondent is not liable to pay any charge, in the event of any energy injected from 01.06.2023; and c. The respondent is directed to pay for the energy injected from the subject wind projects from the following date pursuant to the interim order earlier granted 11.05.2022 till 31.05.2023, at the rate of Rs. 3.70 per unit, subject to adjustment of any payment made towards it." on 3. In view of the aforesaid final Order passed by the Hon'ble KERC, the Petitioner craves leave to withdraw the above Petition. It is therefore prayed that this Hon'ble Court may be pleased to dismiss the above Petition as withdrawn, in the interests of justice and equity. 2. The memo is taken on record. 3.
