M. SUNDAR For the petitioner : For the respondent : Md. Shakir Khan Date of order : 12-08-2026 ORDER (ORAL) [1] This common order will govern the captioned three ‘civil revision petitions’ (‘CRPs’ for the sake of brevity). [2] Instant order has to be read in conjunction with and in continuation of earlier proceedings made in previous listings by this Court, more particularly proceedings made by Hon’ble predecessor Chief Justice in the listing on 05-08-2025 and the proceedings made in the previous listing on 29-07-2026 which read as follows:— ‘05.08.2025 Learned counsel for the petitioner, Mr. H. Kenajit is on record and represented by learned counsel, Mr. Albert Keisham; and learned senior counsel for the respondent, Mr. T. Rajendra in on record and represented by Mr. Bikash Sharma. Learned counsel for the petitioner who is present 2026:MNHC:169 CRP(C.R.P. Art. 227) Nos, 72, 73 & 74 of 2019 before the Court physically, submits that the learned counsel, Mr. H. Kenajit had issued NOC to the petitioner along with case related documents in all these matters and as regards this submission, he is filing memo to that effect and the same is taken on record. Therefore, keeping in view the status in these matters that the aforesaid learned counsel for the petitioner had issued NOC to the petitioner along with case related documents, it is deemed appropriate that the learned counsel be permitted to retire from the cases as is sought for. Consequently, it is deemed appropriate to issue Court notice to the petitioner/Assemblies of God East India, in all these matters. Accordingly issue process. Hence, these matters would be listed on 28.08.2025.’ ‘29.07.2026 [1] Mr. Johnson, learned counsel representing Mr. Md. Shakir Khan, learned counsel on record for respondent is present in Court (physical Court). [2] Read this in conjunction with and in continuation of earlier proceedings made in the previous listings. [3] After the last listing on 25.05.2026, there are two notes put up by the Registry, one dated 05.06.2026 and another dated 28.07.2026 and they read as follows: ‘05/06/2026 The registry received a letter from the Superintendent of post offices, Manipur Division, Imphal stating no tracking record was found due to the article was booked quite long ago. So, fresh step has taken upon the petitioner for service of notice to engage a new counsel by way of speed post.’ 2026:MNHC:169 CRP(C.R.P. Art. 227) Nos, 72, 73 & 74 of 2019 ‘28/07/2026 According to Tracking Report it delivered confirmed (Addressee) on dated 22.06.2026. Vakalatnama on behalf of petitioner has not filed. Since, notice has served to petitioner, the service is completed.’ [4] The revision petitioner whose counsel’s vakalatnama has since been determined has now been duly served and name of the revision petitioner is shown in the cause- list but this Court is informed that the revision petitioner has not chosen to enter appearance through counsel. Revision petitioner has not come before this Court either in the physical Court or on the Video Conferencing (V.C.) platform. However this Court, with the intention of giving further opportunity to the revision petitioner, deems it appropriate to direct the Registry to list the matter again showing the full name and address of the revision petitioner as in the cause-title of the memorandum of revision petition. [5] Next listing will not be under the caption ‘SERVICE NOT COMPLETED’ and Registry to list under a suitable cause- list caption on 12.08.2026. [6] It is made clear that if the revision petitioner does not choose to enter appearance through counsel (new counsel) or come before this Court in the next listing also this Court may have to pass appropriate orders. [7] List on 12.08.2026.’ [3] In the hearing today, Mr. Md. Shakir Khan, learned counsel on record for the lone respondent is present before this Court (physical Court). [4] However, as regards CRP petitioner, this Court is informed by the Registry that CRP petitioner has not chosen to enter appearance through new counsel. Be that as it may, CRP petitioner has also not chosen to come 2026:MNHC:169 CRP(C.R.P. Art. 227) Nos, 72, 73 & 74 of 2019 before this Court [either in the physical Court or on the Video Conferencing (VC) platform]. Therefore, in the light of the trajectory the matter has taken, proceedings made in the previous listings and more particularly, paragraph No. 6 of proceedings made in the previous listing on 29-07-2026, captioned three CRPs cannot but be dismissed for default/non-prosecution. This is more so as adequate and ample opportunities have been given to revision petitioner inter alia by sending notice from the Registry after determination of vakalatnama of erstwhile counsel of CRP petitioner. [5] Ergo, the sequitur is, captioned three CRPs are dismissed for default/non-prosecution. [6] There shall be no order as to costs.
