Order 26/05/2026 : The present writ petition has been filed by the petitioners under Article 226 of the Constitution of India with the following prayers :-
“It is, therefore, most respectfully prayed that this Hon’ble Court may graciously be pleased to accept and allow this writ petition and direct the respondents to reassess compensation including the value of the houses and Devsthans situated on land bearing Khasra number 351, 359 and 360, situated in Village Chauki, Tehsil Chhabra, District Baran (Rajasthan).
[2026:RJ-JP:22272] (2 of 3) [CW-6926/2026] Any other relief which this Hon’ble Court deemed just and proper in the facts and circumstances of the case may also kindly be passed in favour of the petitioners.”
Learned counsel appearing for the petitioners submitted that the petitioners are recorded khatedars & co-sharers of the land bearing Khasra Nos.351, 359 & 360 situated at Village Chauki, Tehsil Chhabra, District Baran, Rajasthan. Counsel further submitted that pursuant to the notification dt.06.01.2020 issued by the respondent-Department, the aforesaid land came to be acquired by respondent No.2. Counsel also submitted that the petitioners had constructed certain kachha houses & two Devsthans over the aforesaid land; however, the concerned Patwari failed to mention the said constructions in the Survey Report, as a consequence whereof, compensation in respect thereof was not awarded. Counsel contended that although, the petitioners submitted a representation before the General Manager, Railway (Kota Division) with copies forwarded to the District Collector & respondent No.2, no action has been taken thereupon. Aggrieved by the inaction on the part of the respondents, the petitioners have preferred the present writ petition. Mr. V.D. Gathala, learned Additional Government Counsel puts in appearance on behalf of the respondents No.1 & 2. Therefore, service is treated as complete. Heard learned counsel for the parties & perused the material available on record. Upon arguing the matter to some extent, learned counsel appearing for the petitioners confined his prayer & submitted that the present writ petition may be disposed of, with liberty to the petitioners to submit a fresh representation before the concerned authority alongwith a direction to the said authority to consider & decide the

Learned counsel appearing for the respondents has no objection, if the limited prayer made on behalf of the petitioners is allowed. Having regard to the facts & circumstances of the case and considering the submissions advanced by learned counsel appearing for the respective parties, this Court deems it appropriate to dispose of the present writ petition with the following directions :- (i) The petitioners shall be at liberty to submit a fresh representation before the concerned authority within a period of fifteen days from the date of this
order. (ii) Upon receipt of such representation, the competent authority shall consider & decide the same in accordance with law within a period of two months. (iii) While deciding the representation, the competent authority shall afford an adequate opportunity of hearing to the petitioners." Accordingly, the present writ petition stands disposed of. Pending applications, if any, also stand disposed of.
