Case No.1433 of 2025 dated 29.11.2025 under Sections 126(2)/118(2)/109/303(2)/74 and 3(5) and adding Section 89 of the BNS. And In the matter of: Altab @ Altab Hossain & Anr. ….Petitioners. Mr. Soupal Chatterjee Ms. Mekhala Kar …for the petitioners. Mr. Md. Adil Badr Mr. Subhajit Chowdhury …..for the State. Leave is granted to amend the cause title. Learned counsel appearing on behalf of the petitioners submits that an altercation took place between the private parties. No grievous injury was caused. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He relies on the injury report of the victim and the statements recorded before the learned Magistrate as well as the statements of eye-witnesses. The petitioners had severely beaten up the victim resulting in her miscarriage. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. 2 Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
