Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Kanke P.S. Case No. 69 of 2025, registered for the offence under Sections 191(2), 190, 126(2), 115(2), 303(2), 352 and 74 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Ranchi.

Learned counsel appearing for the petitioners submits that there is land dispute and false allegations are made against the petitioners of digging the land. He next submits that the fact remains that the said land was settled in favour petitioner no.1 by the grandfather of the petitioner no.1. He further submits that although the allegations are there of assault, but there is no injury. On these grounds, the anticipatory bail may kindly be granted.

Learned counsel appearing for the State has opposed the prayer and submits that the allegations are there of assault.

Annexure 2 is a document which prima facie suggests that the said land was settled in favour of petitioner no.1. On query made by the court,
learned counsel for the State has fairly submitted that injury is not found which prima facie suggests that by way of creating the story, the case has been lodged. In the attending facts and circumstance, the above-named petitioners are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ranchi, in connection with Kanke P.S. Case No. 69 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
