Counsel for the Petitioner: D KASI RAO Counsel for the Respondents: GP FOR ENERGY The Court made the following order: 3 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 22243 OF 2026 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: “to issue an order, writ or direction more particularly in the nature of Writ of Mandamus declaring the rejection proceedings of the 5th Respondent in Letter No. GM(P)/EE(P3)/AEE(P3)/D.No.3182/25 dated 26.09.2025 and the appellate proceedings of the 4th Respondent in Letter No. APSPDCL/TPTPO/RTI/F.No.134/25/D.No.364/25 dated 01.10.2025 as illegal, arbitrary, unconstitutional and contrary to the Right to Information Act, 2005 and consequently set aside the said proceedings and direct the respondents to furnish the information sought in the RTI applications dated 19.06.2025 and 27.06.2025 free of cost under Section 7(6) of the Act and pass such order or orders….” 2. Heard learned counsel for the petitioner, learned Government Pleader for Energy, learned Standing Counsel for respondent Nos. 2 to 5 and Sri Kambhampati Ramaesh Babu, learned counsel for respondent No.6. 3. The case of the petitioner herein is that the petitioner submitted an applications dated 19.06.2025 and 27.06.2025 under Section 6 of the Right to Information Act, 2005, seeking information before the respondent No.3, who is an public information officer as designated under RTI Act. But the said applications were rejected by respondent No.5 vide rejection proceedings dated 26.09.2025. Aggrieved by the said rejection, the petitioner assailed the 4 said proceedings before respondent No.4, who is the first appellate authority as notified under the provisions of the RTI Act. Without considering the grounds raised by the petitioners, the appellate authority provided information vide proceedings dated 01.10.2025. But the petitioner herein assailed the proceedings/order passed by the first appellate authority/respondent No.4 by way of an appeal before the Commissioner/Respondent No.6, who is the Second Appellate Authority on 18.10.2025, the same is pending for consideration. 4. On the other hand, learned Standing Counsels for respondent Nos. 2 to 5 and 6 submits that the petitioner was provided information by the appellate authority in terms of the RTI Act, 2005. However, since the petitioner preferred the Second Appeal, the respondent No.6 issued summons on 27.07.2026 and posted the matter on 11.08.2026 for hearing. It is further submitted that if the petitioner appeared before the Commissioner on that day, the matter can be disposed of or at the consent of both the parties it may be posted to other day for resolution of the same. In view of the summons issued by the authorities, respondent No.6 is taking steps for disposal of the same. 5. Heard the learned counsel for both the parties and perused the material placed on record. In view of the summons issued by respondent No.6 herein, this Court is of the considered view the present Writ Petition can be disposed of, directing the respondent No.6 to dispose of the Second Appeal dated 18.10.2025 pending before him, within a period of two(2) months from the date of receipt of copy of this Order. 5 6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
