The petitioner is apprehending his arrest in connection with Sindri P.S. Case No.86 of 2024 for the alleged offences registered under Sections 317(5), 238 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M. 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and only on the confessional statement the name of the petitioner has come. He further submits that the petitioner is having criminal antecedent, however, the criminal antecedent cannot be sole criteria of rejecting the anticipatory bail application. 4. Learned counsel appearing for the State opposed the prayer and submits that serious allegations are there against the petitioner 2026:JHHC:12924 --2-- A.B.A. No. 2209 of 2026 of involving in a gang of motorcycle theft and in view of that anticipatory bail may kindly be rejected. 5. Considering that the name of the petitioner has been taken by accomplice of the petitioner saying that the petitioner was also involved in theft of motorcycle and identical nature of three cases are there against the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, hence, the prayer for anticipatory bail of the petitioner is hereby rejected.
