Mr. Subhasish Pachhal, Mr. Sekhar Barman ……for the Petitioners. Mr. Sanjay Banerjee, Ms. Smita Saha ……for the State. 1. Learned Advocate appearing for the petitioners submits that 21 kilograms of ganja was recovered from one of the petitioners and from the another petitioner, 14 kilograms of ganja was recovered. As such, the subject matter of the case relates to recovery of 35 kilograms of ganja. 2. It has been also pointed out by the learned advocate that out of 14 witnesses cited in the charge sheet, only two witnesses till date have been examined. 3. Learned Advocate for the State opposes the prayer for bail and prays for some more opportunity to expedite the process of trial. 2 4. Be that as it may, having regard to the period of detention of the present petitioners, I am of the view that further incarceration is unwarranted. 5. In view of the above, the prayer for bail is allowed. 6. Accordingly, the petitioners viz, Akkas Sheikh @ Akkash Ali and Tinku Sheikh @ Tinku shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/-, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act at Barasat, North 24 Parganas. 7. If on bail, the petitioners shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of North 24 Parganas without prior permission of the learned Special Court. 8. The application for bail, being CRM (NDPS) 150 of 2026 is, thus, disposed of. 9. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
