Heard the parties. 2. The present writ petition has been filed for the following reliefs:- “i. To quash the order dated 12.12.2017 (Annexure-4) passed by the Deputy Commissioner, Palamau in P.D.S. License Appeal No. XV/01 of 2015 and 2016, whereby and whereunder the appeal preferred by the petitioner has been dismissed for non-prosecution without adjudication on merits, during the period when the petitioner was suffering from serious illness; ii. To quash the order dated 03.08.2022 (Annexure-5) passed by the Commissioner, Palamau Division, whereby the revision petition filed by the petitioner has been dropped on account of his continuous absence, without considering the fact that such absence was due to the petitioner's serious medical complications and unavoidable circumstances. iii. For a direction upon respondents to restore the PDS licence No. 58/1992 of the petitioner and allow the petitioner to run his PDS shop in accordance with law.” 3. It has been submitted that due to non appearance of the advocate, the impugned orders contained in Annexure-4 and 5 of the present writ petition has been passed. 4. It has been further submitted that although “Hazri” has been filed. 2026:JHHC:2061 2 W.P.(C) No.164 of 2026 5. Hazri is not considered as an appearance. 6. However, considering the fact that the appeal has not been decided on merit, with a view to give an opportunity to the petitioner, the impugned order dated 12.12.2017 (Annexure-4) passed by the Deputy Commissioner, Palamau in P.D.S. License Appeal No.XV/01 of 2015 and 2016 is, hereby, set aside and the appeal is, hereby, restored. 7. The petitioner is directed to appear before the concerned authority within two weeks from today. If the petitioner appears before the authority within two weeks from today with the copy of the present order, the authority is directed to decide the issue on merit after following due process of law giving due opportunity to the affected parties. 8.
