THE HONOURABLE SMT JUSTICE SUNITHA GANDHAM WRIT PETITION NO: 42573 OF 2022 ORDER:
This writ petition is filed to direct respondent authorities not to interfere in the civil disputes and not to call the petitioner to the Tsundur police Station, without there being any specific complaint against the petitioner and also direct the respondent No.4 not to take any adverse action against the petitioner without there being any complaint against the petitioner. 2. Case of the petitioner is that she is having land in an extent of Ac.3.85 cents in survey Nos.555/1 and 555/6, Yadlapalle Village, Tsundur Mandal, and she has been cultivating the same, whereas, respondent No.5 is trying to interfere with the possession and enjoyment of the petitioner with the help of police and the respondent No.4 regularly calling the petitioner to the police station, threatening her in dire consequences that he would file false cases against the petitioner. Being lady, petitioner has been facing difficulties in the hands of respondent Nos.4 & 5 and though respondent No.4 has no right to interfere in the civil disputes, he has been supporting the respondent No.5 and harassing her. 3.
Learned Assistant Government Pleader filed written instructions given by the respondent No.4 i.e., Station House Officer, Tsundur police station and in which it is mentioned that so far, no crime is registered against the petitioner and in the year 2022, when the husband of the petitioner gave

representation to the Superintendent of police, Bapatla, seeking police protection, an enquiry was conducted and advised the petitioner and her husband to approach the civil court in view of the disputes between the petitioner and respondent No.5 and further, he would not interfere in the matter unless there are any specific directions from the Court. 4. Heard Sri Narra Srinivasa Rao, learned counsel for the petitioner and the learned Assistant Government Pleader for Home. 5. Admittedly, no crime is registered against the petitioner and even as per the version of the respondent No.4, SHO of Tsundur Police Station, there are civil disputes between the petitioner and respondent No.5 in respect of land situated in survey Nos.555/1 and 555/6 of Yadlapalli Village, Tsundur Mandal. In this regard, it is to be mentioned that it is well settled that police cannot interfere in civil disputes and the Hon’ble Apex Court repeatedly held that when the dispute is purely of civil nature, jurisdiction under Article 226 of the Constitution cannot be exercised and further, when the dispute between two citizens is of civil nature and no crime is registered, police have no jurisdiction to interfere in the civil dispute. It is also settled that in the scheme of Constitution of India, duty to resolve civil dispute is entrusted to judiciary and police have no such power and involvement of police in a pending civil dispute or potential civil dispute between two citizens or two groups of citizens is not within the provisions of the police. 4 SUN, J WP_42573_2022
6. As per the version of the Sub Inspector of Police, Tsundur Police Station, except advising the petitioner and her husband to approach civil court, he has not done anything and he will not interfere in the civil disputes between the petitioner and respondent No.5. 7.
Since respondent No.4 has submitted written instructions stating that he will not involve in the civil disputes which are pending between the petitioner and respondent No.5, this Court is of the considered view that this writ petition may be disposed of directing the respondent No.4 not to interfere in the civil disputes of the petitioner and respondent No.5. 8. In the result, this Writ Petition is disposed of with a direction to the respondent No.4 not to interfere in the civil disputes, if any, pending between the petitioner and respondent No. 5. There shall be no order as to costs. As a sequel there to, pending miscellaneous petitions, if any, shall stand closed. _____________________ SUNITHA GANDHAM, J
