The petitioner is apprehending his arrest in connection with Jirwabari P.S. Case No. 183 of 2024, registered for the offence under Sections 318(4) and 316(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Sahibganj. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case and the petitioner has already informed the superiors of pilferage of the food grains due to damage of the godown, however, no action has been taken. He further submits that now the FIR has been registered against the petitioner alleging of missing food grain to the tune of Rs.4158.47655 quintals of food grains amounting to Rs.01,66,33,906.00. He further submits that the charge against the petitioner is wrong and in view of that, anticipatory bail may kindly be granted. 4. Learned Special P.P. appearing for the State has opposed the prayer and submits that in spite of the demand made by the superior authority, the petitioner not produced the registers of outgoing and incoming grains and allegations are serious of pilferage of the food grains to the tune of Rs.01,66,33,906.00 and further Rs.8,48,800.00. 5. Considering that the allegations are there against the petitioner of pilferage of food grains amounting to Rs.01,66,33,906.00 and further Rs.8,48,800.00 and the petitioner was directed to produce the incoming and outgoing chart of the food grains and not produced and serious allegations are there, I am not inclined to grant anticipatory bail to the petitioner. 6.
