JUSTICE SANJAY DHAR, JUDGE ORDER(ORAL) 1) Learned Principal District Judge, Bandipora, has made the instant reference recommending transfer of the suit titled “Sayedullah Nasiroo vs. Farooq Ahmad Nasiroo & ors.” (CNR No.JKBP020002072024) from the Court of Civil Judge (Senior Division), Baramulla, to an appropriate court. 2) In the order of reference, it has been submitted that valuation of the suit has been fixed at Rs.25,100/ and the said suit is triable by the Court of Civil Judge (Senior Division). It has been submitted that the Presiding Officer of the Court of civil Judge (Senior Division) has recused himself from hearing the case and there is no other court of competent jurisdiction available within District Bandipora. 3) It seems that the learned Principal District Judge, Bandipora, is not aware about the amendment effected to the Jammu and Civil Courts Act by virtue of Act No.VI of 2026, whereby the pecuniary jurisdiction of Civil Judge (Junior Division) has been enhanced upto Rs.10.00 lakhs. 4) In view of the aforesaid amendment, the suit, in respect of which the reference has been made, is eligible to be tried by the Court of Civil Judge (Junior Division). A number of courts of Civil Judge (Junior Division) are presently functioning in District Baramulla. Therefore, the suit can be transferred to any of these Courts of Civil Judge (Junior Division) within District Baramulla. 5) Accordingly, the reference is returned with a direction to the learned Principal District Judge, Bandipora to transfer/assign the suit titled “Sayedullah Nasiroo vs. Farooq Ahmad Nasiroo” to any court of Civil Judge (Junior Division) within District Baramulla.
