The Assistant Directyor of Mines Geology, Kurnool,Kurnool District ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an order or writ one in the nature of writ of mandamus declaring the action of the respondents in insisting the petitioner to pay seigniorage fee of Rs.1,000/- per each polishing machine per month in respect of black limestone slab and Rs.1300/- per machine in case or white and other clour lies stone slabs from the petitioners i.e. cutting and polishing unit holders as arbitrary,illegal, unjust and contrary to Mines & Minerals (Development & Regulation) Act 1957 and AP Minor Mineral Concession Rules, 1966 and pass IA NO: 1 OF 2010(WPMP 21832 OF 2010 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to insist upon payment of seigniorage fee of Rs.1,000/- per each polishing machine per month in respect of black limestone slab and Rs.1300/- per machine in case white and other colour limes stone slabs from the petitioners pending disposal of the above writ petition Counsel for the Petitioners: V L SURENDRA 11 Counsel for the Respondents: GP FOR INDUSTRIES & COMMERCE The Court made the following order: 12 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO:17326 OF 2010 ORDER: Even though this Court issued notices to all the 78 petitioners, but the same were not yet returned. 2. 2. On the other hand, learned Government Pleader furnished written instructions dated 06.08.2026 , wherein it is stated as follows: “It is submitted that the petitioner filed the WP No: 17326/2010 before the Hon'ble High Court of Andhra Pradesh at Amaravathi on the government levy of Rs 1,000/- per each polishing machine per month in respect of black limestone slab and Rs. 1300/-per machine in case of white and other colour stone slabs from the petitioner stone polishing units in contravention of the Mines Minerals Development Regulations Act, 1957 and AP minor Mineral concession Rules, 1966. In this connection, it is submitted that "Slab System" allowed for levying of seigniorage fee as per each polishing machine as per then prevailing framework of APMMC Rules, 1966 for the Granite polishing units prevailed way back at the time of petition filed as amended vide AP minor Mineral concession Rules, 1966, during the course of time then prevalent "Slab system" as enforces has not gained the unanimous consenses among the Granite polishing units across the state and government has rolled back the "Slab system" due to lack of consenses. As things stand, the present existing framework allowing for the Granite polishing units has to obtain the Transit passes for the quantity processes while paying the seigniorage fee to the Government. Hence, the "Slab System" no longer is in force.” 13 3. On perusal of the written instructions submitted by the learned Government Pleader, the respondents insisting for payment of seigniorage fee under the slab system for polishing machine was withdrawn. The seigniorage fee would be collected basing upon transit passes/permits issued by the respondents. Therefore, the grievance of the petitioners was redressed. 4. Considering the submissions made and in view of the Written Instructions, the Writ Petition is disposed of. However, in view of the change of policy for laying seigniorage fee other than slab system, the grievance of the petitioners already redressed. Still if the petitioners are aggrieved, they are at liberty to challenge the same by initiating appropriate proceedings. There shall be no order as to costs.
