This application has been filed under Section 483 of the BNSS, 2023 for enlargement of the accused, Ronal Leya on bail as he is behind bars since 22.02.2026 in connection with NDPS Case No. 05/2026 arising out of Aalo P.S. Case No. 08/2026 under Section 21(b)/20(b)(ii)(A) of the NDPS Act. The charge sheet has been laid against the accused person under aforementioned sections of law. 3. It is submitted on behalf of the accused that the accused is willing to cooperate with the trial and the accused is ready to abide by any stringent bail conditions, if imposed upon him. It is submitted that the accused person’s old mother is seriously ailing and he has to attend to his mother. The annexure-5 of the petition is the medical document relating to the ailments of the accused person’s mother, Yayer Leya. 4. Ms T. Jini, learned Additional Public Prosecutor has raised serious objection by stating that the notice under Section 47 of the BNSS clearly reveals that the accused is a history-sheeter and he was previously arrested in connection with another case registered as Aalo P.S. Case No.54/2024 under Section 21 (b) of NDPS Act. The learned Additional Public Prosecutor has also raised further objection stating that the accused person’s statement under Section 180 of the BNSS clearly discloses that the accused, who was working as mazagine guard at SP office had admitted of purchasing contraband. 5. I have considered the submissions at the bar with circumspection. Page No.# 3/3 6. I have considered the submission that the accused person’s mother is ailing seriously. I have also considered the submission that the accused person is willing to cooperate with the trial. It is also submitted on behalf of the accused that the accused persons has been incarcerated 100 days. 7. Considering the entire aspect of the matter, it appears that the bail may be granted to the accused person. Accordingly, the accused, namely, Ronal Leya is enlarged on bail on furnishing a bail bond of Rs. 30,000/- with 2(two) local sureties of like amount to the satisfaction of the learned Special Judge (NDPS), Aalo under following conditions:- i) That the accused shall refrain from such activities, with which, he has been alleged; ii) That the accused shall not try to influence any witnesses or tamper with the evidence; ii) That the accused shall not leave the jurisdiction of the court without prior permission, till completion of the trial; and 8. On breach of any conditions, the court is at liberty to cancel the bail granted to the accused person. 9. In view of the above, the bail application stands disposed of. JUDGE Comparing Assistant
