The petitioner has filed this petition seeking following relief : “10.1 That, the petitioner most humbly and respectfully prays to this Hon'ble Court to issue appropriate order/direction to the respondent authorities to release the recovered amount payable against gratuity i.e. Rs. 3,95,926/-to the petitioner forthwith. 10.2 That the petitioner most humbly and respectfully prays to this Hon'ble Court to issue appropriate order/direction directing the respondents to pay interest @ 18% on the recovered amount i.e. Rs. 3,95,926/- from the due date. 10.3 Any other relief whatsoever, this Hon'ble Court may deem fit and proper may also be granted to the REKHA SINGH -2- petitioner.” 2. Mr. Ravi Bhagat, learned counsel appearing for the petitioner would submit that the penalty of recovery of Rs.3,95,000/- was passed and said order has already been set aside by the Additional Registrar. It is contended that the order passed by the Additional Registrar has been affirmed in appeal. He would contend that till date, respondent No.3 has not made payment of the gratuity amount. He would further contend that the petitioner may be permitted to withdraw this petition with liberty to approach the Controlling Authority under the Payment of Gratuity Act and a direction may be issued to the said authority to decide it expeditiously. 3. No objection from other side. 4. Permission is granted. 5.
