For the Respondent no. 10 Affidavit of service filed by the petitioners is taken on record. Heard learned counsels for the parties. The petitioners seek implementation of the order dated 12th July, 2019 passed the District Magistrate, Paschim Medinipur and an ad interim order for injunction restraining the private respondents and their associates from making any concrete road over the bastu of the petitioners or disturbing their peaceful possession therein. Learned counsels for the respondents draw the attention of this Court to another writ petition filed by the petitioners seeking identical reliefs as in the present application. Pendency of the said writ petition has been deliberately suppressed by the petitioners in the present application. Such conduct of the petitioners amounts to deliberate suppression of material fact. Also, the prayers in the writ petition do not pertain to police inaction under Group IX of the classification list. 2 It is trite law a person seeking relief from a Court of law should approach the Court with clean hands. Herein, since the petitioners have not approached the Court with clean hands in deliberately suppressing material fact, they are not entitled to any relief. The writ petition is dismissed There shall be no order as to costs. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
