Musabani, District- East Singhbhum. ... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Akshay Kr. Mahato, Advocate For the State : Mr. Praful Jojo, Addl.P.P ------ Order No.04 Dated- 28-04-2026 Heard the parties. The petitioner has been made accused in connection with Kowali P.S. Case No. 34 of 2022 corresponding to G.R. No. 1747 of 2022 (S.T. No. 73 of 2025) registered for the offences punishable under Sections 302, 201, 120B of the I.P.C. This is the second journey of the petitioner with the prayer for regular bail, as earlier the prayer for regular bail of the petitioner was rejected vide order dated 13.06.2025 in B.A. No.4089 of 2025. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed murder of Lav Kumar Mandal. It is then submitted that the fresh ground is that so far three witnesses have been examined during trial of the case. The certified copy of the deposition of the witnesses have been annexed as Annexure-2 series of this bail application including the brother of the deceased, but none of them has stated anything in their respective deposition to implicate the petitioner in this case, in any manner. It is next submitted that the co-accused person who faced the trial have been acquitted vide judgment dated 15.01.2026 in S.T. Case No. 47 of 2023. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case. It is lastly submitted that the petitioner has been in custody since 17.05.2023. Hence it is submitted that the petitioner be admitted to bail. Learned Addl.P.P. opposes the prayer for bail of the petitioner. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Jamshedpur in connection with Kowali P.S. Case No. 34 of 2022 corresponding to G.R. No. 1747 of 2022 (S.T. No. 73 of 2025) with the condition that he will co- operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case.
