The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.75/2026, registered at Police Station – Seepat, District – Bilaspur (C.G.) for the alleged commission of offence punishable under Sections 296, 115(2), 118(2), 351(3), 3(5), of BNS, 2023. 2. As per prosecution story, in brief, is that the complainant Aditya Singh lodged report at Police Station, Seepat, alleging therein that on VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.04.23 12:51:39 +0530 2 04.02.2026, his elder cousin brother namely Shubham Singh came in the house of complainant for taking food, where due to some previous dispute, one Jasveer Singh @ Chhotu has abused to Shubham Singh with filthy languages and assaulted him with the help of baseball. On the basis of said report, the offence 115(2), 296, 351(3) of IPC was registered against Jasveer Singh @ Chhotu and later on the offence U/s 118(2) & 3(5) of BNS has been added. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits that applicant neither involved in the commission of crime nor tried to commit any offence. It has been argued by learned counsel for the applicant that due to some previous dispute, one Jasveer Singh @ Chhotu has abused to Shubham Singh with filthy languages and assaulted him with the help of baseball and injured person was received grievous injury on his body parts. He also submits that there is no allegation levelled against the applicant and he roped an accused only on the basis of memorandum statement his name came into light, therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel opposes the anticipatory bail application of the present applicant and submits that due to some previous dispute, one Jasveer Singh @ Chhotu has abused to Shubham Singh with filthy languages and assaulted him with the help of baseball and injured sustained grievous injury and as per the memorandum statement of co-accused present applicant was also involved in crime in question, therefore, they are not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. Considering the nature and gravity of the offence, and also taking into account the fact that on the date of incident due to some previous dispute, one Jasveer Singh @ Chhotu has abused to Shubham Singh with filthy languages and assaulted him with the help of baseball, as a result injured sustain grievous injuries on his body parts. Further as per the memorandum statement of co-accused present applicant was also involved in crime in question. Accordingly, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant– Vishwajeet Singh, filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved Crime No.75/2026, registered at Police Station – Seepat, District – Bilaspur (C.G.) for the alleged commission of offence punishable under Sections 296, 115(2), 118(2), 351(3), 3(5), of BNS, 2023, is rejected.
