2. By way of this application, the applicant is seeking relaxation of bail condition no.(c) imposed by this Court vide order dated 19.03.2025 passed in Criminal Application No.1247 of 2024, which reads as follows :
“(c) The applicant shall attend the concerned police station twice in a month, on 1st and 15th of every month, and the police station officer shall record his presence.’

Learned counsel for the applicant submits that since the date of the passing of the order, the applicant is attending the concerned Police Station and most of the dates of the Court as directed by this Court. He is the resident of Upper Beniasole, Adra, Arra, West Bengal and therefore, it is very difficult for him to attend the police station twice in a month. Therefore, considering the aforestated fact, condition no.(c) is prayed to be relaxed.
4. On the other hand learned APP opposed the 2026:BHC-NAG:12017
2 19.appp.3009.2026 application on the ground that the applicant is the resident of West Bengal and therefore, with some object and purpose, this Court has imposed the aforesaid condition and also as the offence is serious in nature i.e. under NDPS act, therefore, prayed to reject the application.
5. I have considered the rival submissions and perused the record. It appears that the applicant is regularly attending the police station as directed, since the date of passing of the order. So also, on most of the dates, the applicant has also attended the Trial Court.
6. Considering all these facts and circumstances, I am inclined to allow the application. Hence, the following order : (a) The application is partly allowed. (b) Condition no.(c) imposed by this Court vide
order dated 19.03.2025 is hereby modified. The applicant shall attend the concerned police station once in a month i.e. on 15th of every month.
7. The application stands disposed of.
