Ejectment order against the peoner-tenant was passed by learned Rent Controller, Jalandhar on 16.03.2024 in respect of a demised shop, in a peon filed under Secon 13 of the East Punjab Rent Restricon Act vide Annexure P-1. The peoner-tenant filed appeal. The Appellate Authority vide its order dated 09.04.2025 stayed the operaon of the ejectment order, subject to the condion that the appellant-tenant had to pay the arrears of rent from 01.05.2023 ll 16.03.2024 @ 2,400/- per month; and mesne profits @ 4,000/- per month from 17.03.2024 ll disposal of the appeal. The appellant (peoner herein) was allowed specific me to clear the arrears, but the peoner failed to do so. The Appellate Authority vide impugned order dated 25.03.2026 (Annexure P-4), vacated the stay order on the applicaon moved by the landlord due to the failure of the peoner to comply with the order 09.04.2025.

Assailing the aforesaid order, learned counsel for the peoner submits that the peoner was ready with an amount of 75,000/- on 27.05.2025 so as to pay the same to the landlord, but he refused to receive the same. Learned counsel further submits that as of now the total arrears work out to be 1,27,000/- and that he is ready to pay the same to the respondent up to 25.05.2026, the date already fixed before the Appellate Authority.

Having noced the contenon of learned counsel for the peoner, present revision peon stands disposed of with a direcon to the peoner herein to deposit the enre arrears as per order dated 09.04.2025 of the Appellate Authority, on or before 25.05.2026. Till that date, the order of ejectment shall remain stayed. However, in case, the peoner fails to clear all the arrears up to 25.05.2026, then this order will have no effect and the ma9er shall be considered by the Appellate Authority on merits.
