P.P., Assam appearing on behalf of the State respondent. This is an application under Section 483 of BNSS, praying for grant of bail to the accused/petitioner, namely, Pinku Mudoi who has been arrested on 30.04.2026, Page No.# 2/3 in connection with the Dispur P.S. Case No. 246/2026, under Sections 61(2)/318(4)/ 336(3) of the BNS, 2023. Today the case was fixed for case diary but it is submitted by Mr. Borthakur, the learned Addl. P.P., Assam that the Dispur P.S. Case No. 246/2026 has already been charge sheeted vide Charge Sheet No.260/2026 dated 30.05.2026. In that context, the report received from the I.O. be kept in the case record. It is submitted by Mr. A. Ahmed, learned counsel that the accused petitioner is in the custody since last 67 days and considering his length of detention, the bail prayer may be considered. However, he will face the trial by appearing before the learned Trial Court below, on each and every date, to be fixed by the learned Trial Court. Further it is submitted by the learned counsel for the petitioner that the only allegation brought against the present accused petitioner is that he was using the number plate of the car of the informant. Apart from that, there is no other allegation against the present petitioner. Furthermore, it is the case of the accused petitioner that he is running a travel agency, wherein two vehicles are given on rent and out of which, one vehicle was stolen and in that context, he also lodged an FIR in the Basistha Police Station which has been registered as the Basistha P.S. Case No.53/2026. But without making any inquiry to that regard, the accused petitioner got arrested in connection with the present case. The learned counsel further submitted that the two vehicles which were under his agency, have the registration number and the same has already been annexed along with the present bail petition. Mr. Borthakur, the learned Addl. P.P., Assam submitted in this regard that he cannot say much about the merit of this case as the case diary is not available Page No.# 3/3 before the Court today Considering the submissions made by the learned counsels for both sides and without going other detail on the merit of the case and only considering the length of detention, undergone by the accused petitioner, this Court is of the opinion that further custodial detention may not be required. Accordingly, it is provided that on furnishing a bond of Rs. 30,000/- (Rupees thirty thousand) only with one surety of like amount, to the satisfaction of the learned CJM, Kamrup (M) at Guwahati, the accused petitioner, namely, Pinku Mudoi shall be enlarged on bail, subject to the following conditions: (i) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; (ii) that the petitioner shall not leave the jurisdiction of the learned CJM, Kamrup (M) at Guwahati, without prior permission, and (iii) that the petitioner shall submit copy of his Aadhar Card and PAN Card before the learned CJM, Kamrup (M) at Guwahati.
