JUSTICE PRAMIL KUMAR MATHUR Order 22/05/2026 1. Apprehending his arrest in connection with FIR No.128/2025 registered at Police Station-Bhinai, District-Ajmer for the offences under Sections 318(4) and 61(2) of BNS, 2023, Sections 3 and 7 of Essential Commodities Act, 1955 and Section 19 of Fertilizer (Control) Order, 1985 the petitioner has preferred this bail application under Section 482 BNSS. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the prime allegation against the present petitioner is that he violated the provision of Fertiliser (Inorganic, Organic or Mixed) (Control) Order, 1985, as plastic bags bearing the mark “BIO-NPK” [2026:RJ-JP:21820] (2 of 3) [CRLMB-4323/2026] were allegedly found in his conscious possession. It is contended that, in compliance with the earlier order dated 13.04.2026, the petitioner has joined the investigation. Nothing has been recovered from his conscious possession. The investigation qua the present petitioner stands completed. Hence, the anticipatory bail of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. The Investigating Officer, Mr. Omprakash, SHO, Police Station Bhinai, District Ajmer, is present in the Court and submits that no custodial interrogation of the petitioner is required and the investigation stands completed. 6. Considering the nature of allegations and the fact that the petitioner has joined the investigation of the case but without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the anticipatory bail application of the petitioner. 7. Accordingly, the bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner-Parmeshwar Kumar Prajapat S/o Shri Jethmal Prajapat, he shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; [2026:RJ-JP:21820] (3 of 3) [CRLMB-4323/2026] (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade his from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
