JUDGMENT: (per Hon’ble Sri Justice Ravi Nath Tilhari)
Respondent No.1 filed W.P.No.21384 of 2023, which was allowed in the following terms:
“17. Therefore, the Writ Petition is allowed and fixing of ex gratia payable to petitioner at Rs.21.00 lakhs per acre is untenable and the 4th respondent is
directed to compute the compensation payable to the petitioner strictly in accordance with the decision in Mekala Pandu’s case (supra 1) by applying the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and pay the compensation to the petitioner as per market value with all benefits (after deducting the compensation already paid to the petitioner) as payable to owners of such land, within three months from the date of receipt of a copy of this order. No costs.”
2. This appeal has been filed along with application for condonation of delay of 73 days in filing the appeal.
3. On 16.07.2026, the following order was passed:
“On 25.06.2026, the following order was passed:
“Sri Mocherla Deepak Bhargavaram, learned counsel representing the writ appellant’s counsel on record, submits, on instructions, that

negotiations for an amicable settlement of the dispute are going between the parties, and prays for three (03) weeks’ time. At his request, list on 16.07.2026.”
2. Learned counsel for the appellant submits that negotiations are still going on and seeks a short adjournment.
3. Post on 06.08.2026.”
4. None appears for the appellant today.
5. Sri Bharath Simha Reddy, learned counsel for respondent No.1 (writ petitioner) submits that respondent No.1 has been paid the amount of compensation in terms of the judgment passed in the writ petition. However, the interest has not been paid.
6. From the aforesaid order dated 16.07.2026, it is evident that it was stated previously also on 25.06.2026 that the negotiations were going on.

Learned counsel for the writ petitioner submits that no negotiations are going on.
8. Recording the aforesaid as none appears for the appellant, I.A.No.2 of 2026 is rejected as non-prosecution. Consequently, the Writ Appeal is dismissed as barred by limitation.
No order as to costs.
