Learned advocate appearing for the petitioner submits that there has been alleged recovery of 110 bottles of Phensedyl from the possession of the petitioner and another. Petitioner is in custody since 25.09.2025; charge-sheet has been submitted but without the chemical examiner’s report. State has relied upon eight witnesses in the charge-sheet. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the quantum of seizure of contraband, the period of detention and the fact that some time will be required to take the trial to its logical conclusion as till date supplementary charge-sheet along with the chemical examiner’s report has not been submitted. Having considered the same, I am inclined to release the petitioner 2 on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Pankaj Roy shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act-cum-Additional District Judge, 5th Court at Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 660 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
