JUSTICE SAMEER JAIN Order 22/05/2026 Learned counsel for the petitioner has submitted that present petition is filed for directing respondents to grant NOC to the petitioner-institute for opening a nursing college for B.Sc. Nursing course with 60 seats. It is submitted that as per the Policy of 2024, within upper limit of 90 days, the said decision should have been taken, however, the same has not been complied with by the respondents in the matter at hand. It is further submitted after carrying out inspection of B.Sc. Nursing course, appropriate [2026:RJ-JP:21889] (2 of 2) [CW-5304/2026] decision for the same should have been taken within a fifteen days time. It is also submitted that petitioner is a standard college with a brand name and has put crores of rupees qua the development of infrastructure. Learned counsel for the respondents has submitted that it is an admitted fact that policy was advertised by the State for intake of B.Sc college and the NOC was to be granted in a specified time, but on account of alarming mushroom growth of Colleges, and on the contrary, a line of vacant seats with the similar kind of Colleges, a policy decision has to be taken by the State that whether such rapid growth will affect the quality standards in the field of B.Sc Nursing or otherwise; for the same the respondent- State is under the process of brainstorming and formulation of a conclusive decision. Considering the aforesaid, and in view of the consensus drawn inter-se the parties, this Court is disposing of the writ petition with a direction that the case of the petitioner be considered within a period of thirty days, from the date of passing of this order, by the respondents.
