1. Heard.
2. This is an application filed for condonation of delay in filing the application for restoration of the Second Appeal. The applicants have stated that the advocate engaged by them in the matter failed to remove the office objections and did not inform the appellants about the same. Consequently, there has been a delay of 559 days in filing the application for restoration.
3. The learned Advocate whom the appellants thereafter engaged, namely, Mr. Rangari, passed away, and therefore, the restoration application remained pending and could not be listed. Though the applicants have made allegations against the earlier advocate that he had failed to remove the office objections and had not informed them Kavita
2 / 2 5-mca 573-26 about the same, considering the overall circumstances, including the subsequent demise of the advocate and the delay of 559 days in filing the application for restoration, the delay is required to be condoned.
4. Accordingly, the delay of 559 days in filing the application for restoration is condoned, subject to the appellants depositing costs of Rs.25,000/- in the account of 'Public Welfare Account' bearing No.129712010001014, IFSC Code UBIN0812978 with Union Bank of India, Branch High Court, Civil Lines, Nagpur.
5. The registry is directed to restore the appeal to its original stage.
6. Civil application stands disposed of.

1. The appellants are direct to remove the office objections within a period of two weeks from today,
