This petition has been preferred by petitioner under Article 226 of the Constitution of India seeking following reliefs:- RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.04.21 10:54:41 +0530 2 “10.1 That, the Hon'ble Court may kindly be pleased to issue strictly direction to the respondent authorities to consider objection made by the villagers and petitioner for removing construction of Vistar Agro Foods Pvt. Ltd. from Agriculture land within stipulated time looking to future of spreading of pollution of Vistar Agro Foods Pvt. Ltd. for cultivators and students, in the interest of justice. 10.2 Any other relief, which the Hon'ble Court may deem fit and proper in the facts and circumstances of the case may also be granted in favour of the petitioner.” 2. Learned counsel for the petitioner submits that the petitioner is the elected Up-Sarpanch of Gram Panchayat Bhaismuda, Block Dharsiwa, District Raipur (CG). He further submits that private respondent No.5 is constructing Vistar Agro Foods Pvt. Ltd. on agriculture land bearing Khasra No.600/2, area 0.0650 hectares, situated at Village Bherwa, P.H. No.01, Revenue Circle Dharsiwa, District Raipur, without obtaining permission from the Gram Panchayat. He further submits that if the said industry is permitted to be eastablished, it will cause pollution and adversely affect the health of villagers. Learned counsel also submits that the petitioner had made a complaint (Annexure P-1) to the respondent authorities, but no action has been taken. Hence, it is prayed that the petitioner may be permitted to file a fresh application/representation before the Collector, Raipur for redressal of his grievance, and that the Collector be directed to decide the same within a stipulated period. 3. In reply, learned counsel for the State/respondent Nos.1 to 4 submits that, as per the documents filed by the petitioner, the land on which the said industry is being established has been diverted for industrial purposes, and private respondent No.5 is the owner of the said land. 3 However, he further submits that if the petitioner files an application/representation, the same shall be decided by the Collector, Raipur, in accordance with law. 4. Heard learned counsel for the parties and perused the material available on record. 5. Having considered the limited grievance of the petitioner, without entering into the merits of the case, the present writ petition is disposed of at this stage, granting liberty to the petitioner to file a fresh application/representation for redressal of the grievance within a period of 15 days from today. In the eventuality of filing such application/representation filed by the petitioner/Gram Panchayat before the respondent No.2/the Collector, Raipur, the same shall be decided in accordance with law within a further period of 45 days from the date of filing of such application/representation along with a copy of this order. 6. With the aforesaid observations and directions, the present writ petition stands disposed of. 7. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
