09.03.2026 (SL-27) NMD Court No.29 CRR 163 of 2025 In the matter of : Jyoti Lal Shaw ….Petitioner Mr. Biswaroop Chatterjee, Ms. Nayonika Chakraborty, Mr. Rajarshi Mitra, Ms. Riya Ghosh …for the Petitioner The petitioner herein is aggrieved with the order dated 12th December, 2024 by which the Court below rejected the petitioner’s prayer under Section 175(3) of the BNSS wherein he has sought for a direction upon the concerned police station to start investigation treating the petition of complaint as FIR. On perusal of the impugned order it appears that the Court below held that the allegation of forgery even if is there, it had taken place at Bihar wherefrom the deed was allegedly executed and, therefore, no part of the allegation false within the jurisdiction of the Court below. Being aggrieved by the aforesaid order, learned Counsel for the petitioner makes an innocuous prayer that he may be given liberty so that he can lodge FIR before the appropriate jurisdictional police station. Having heard learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and as such service of copy of the application upon the opposite parties is dispensed with. 2 The instant application being CRR 163 of 2025 is hereby disposed of giving liberty to the petitioner to lodge fresh complaint if any before appropriate jurisdictional police station and in the event of lodging such complaint the concerned police station will act in accordance with law, without being influenced by any observation made herein.
