This is an application wherein petitioner has prayed for expeditious disposal of ST Case No. 09(06)/2024 presently pending before learned Fast Track 3rd, Paschim Midnapore. Learned counsel for the petitioner submits that from the charge-sheet it appears that the prosecution cited the name of 11 witnesses and out of them prosecution so far completed examination of 8 witnesses but the proceeding remain stalled from 8th May, 2025 and for which the petitioner being a Government employee is suffering a lot. He further submits that on earlier occasion this Court disposed of the application being CRR 1203 of 2023 dated 9th February, 2024 by making specific direction upon the trial court to fix a schedule of three dates and fix such schedule once in every two months so that the trial of the case can be concluded within a reasonable period of time, but said direction passed by this High Court has not been obeyed in it’s letter and spirit. Having considered the aforesaid facts and circumstances of the case it appears that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made in the petition, the opposite party will have no cause to prejudice and as
2 such, service of copy of application upon the opposite party is dispensed with. Having heard the submission made on behalf of the petitioner it appears that the prayer made on behalf of the petitioner is justified and is required to be allowed for the ends of justice. In view of the above, the instant application being CRR 1263 of 2026 is hereby disposed of with a direction upon the Court below to make its best endeavour to conclude the trial preferably within a period of sixty days from the next date of hearing and, if required he will conduct day to day trial and will not grant any unnecessary adjournments to either of the parties. This order is passed invoking this court’s jurisdiction under section 529 of the BNSS. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
