Azam … for the Petitioner(s) Ms. Trina Mitra … for the State The order of bail which is the subject-matter of challenge is dated 22.11.2016 passed by the learned ACJM, Basirhat, North 24 Parganas. The application was preferred in connection with Haroa Police Station Case No. 443 of 2016 dated 20.11.2016. Having considered that the bail was granted to the o.p. no.2 on 22nd November, 2016 and more than nine years have passed in the meantime, I am of the opinion that, at this stage, it would not be wise to interfere with the liberty granted to the o.p. no.2. However, if the proceedings of the said case are still pending before the learned jurisdictional court and, if there are changed circumstances which call for interference, in that case, the petitioner would be at liberty to bring the changed circumstances which are creating impediment in the progress of the case. The learned jurisdictional court/trial court would assess 2 regarding genuinity of the accusations, hear both the parties and pass necessary order as it deems fit and proper. With the aforesaid observations, CRM 16 of 2017 is disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
