SANJEEV PRAKASH SHARMA HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU (through V.C.) Order 25/05/2026 The sole arbitrator has passed an award on 17.12.2006. The objections against the same were raised by the State on 19.08.2021. The application under Section 34 was rejected by the Commercial Court No.3, Jaipur Metro IInd, Jaipur. The present Misc. Appeal has been filed after a huge delay of 1538 days. Although, we had called the Chief Engineer to explain the delay, no satisfactory explanation has come forward. He clearly states that action is going to be taken against the concerned officials. Once an award is being passed and objections (2 of 2) [CMA-338/2026] have been rejected, on very limited aspect, we may entertain an appeal under Section 37 of Arbitration and Conciliation Act that too within limitation. However, the award which was passed in the year 2006 would not be disturbed by us after a period of 20 years. The huge delay is sufficient to dismiss this appeal.
