IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2454 of 2026 Rakesh Singh …. Petitioner Mr. A.K. Subudhi, Advocate -Versus- State of Odisha …. Opposite Party Mr. S.K. Das, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 22.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Info Valley P.S. Case No.238 of 2024 corresponding to G.R. Case No.635 of 2024 pending in the file of learned J.M.F.C., Jatani on the grounds stated therein. 3. Perused the FIR as at Annexure-1. The co-accused persons, namely, Nekei @ Ajaya Dalei, Badal Swain, Sipun @ Sanjay Dalei & Bidyadhar Samantray are stated to be on bail pursuant to the Court’s order dated 26th September, 2024 in ABLAPL No.10414 of 2024. It is stated that the name of the petitioner is not mentioned in the FIR. Learned counsel for the State submits that the accused is having one more criminal antecedent. But the above claim of learned counsel for the petitioner is found incorrect. The allegation in the FIR is regarding demanding of Rs.2.00 lac by the named accused persons. The case diary along with the statement of the witnesses including the informant is submitted to the Court which discloses the name of the petitioner as one among the accused persons, who committed the alleged mischief. Considering the materials on record and the submissions of the learned counsels for the respective parties, this Court is not inclined to entertain the plea of pre-arrest bail of the petitioner, however, is of the view that he should be directed to surrender before the learned court below demanding release for its consideration pleading parity. 4. Accordingly, it is ordered. 5. In the result, ABLAPL is disposed of. It is further directed that in the event, the petitioner surrenders within a period of fortnight from today before the learned J.M.F.C., Jatani in connection with Info Valley P.S. Case No.238 of 2024 corresponding to G.R. Case No.635 of 2024 and moves an application for regular bail, it shall be duly considered in the first hour and in case of rejection, he shall approach the learned Sessions Court during the second hour for orders on the same day considering the plea of parity and for the said purpose, the case record shall be made available. 6. Issue urgent certified copy as per rules. (R.K. Pattanaik) Judge Alok
