Reference may be made to the order dated February 16, 2026, whereby this Court passed the following directions:-
“In view thereof, the Inspector in Charge, Dum Dum Police Station and Inspector in Charge, Nagerbazar Police Station being the 4th and 5th respondents are directed to keep a strict vigil at the locality where the aforesaid two stores are located and to ensure that there is no breach of peace in and around the aforesaid stores. The said respondents shall also take appropriate steps against the persons who may create any obstruction at the entry and exit points of the delivery personnel of the said stores. The respondent nos. 4 and 5 are directed to file separate reports in the form of affidavits stating in details the steps taken by them so as to ensure that there is no breach of peace and tranquility at the locality around the aforesaid two stores.”

Pursuant to the aforesaid direction, the Inspector-in- Charge of the respective police stations through the learned advocate appearing for the State files the reports in the form of an affidavit, which are taken on record. Copies of such reports have been supplied to the learned advocate for the petitioners. Mr. Ganguly, learned senior advocate appearing for the petitioners, on instruction, submits that at present no hindrance is being caused by the private respondents as well others to the peaceful business operations by the petitioner/company. In the said reports in the form of an affidavit, it has been specifically stated that the police is maintaining a sharp vigil over the area in question and is ensuring that no breach of peace and tranquility shall occur.
In the light of the stand taken by the police authorities in the reports filed in the form of an affidavit, WPA 3027 of 2026 stands disposed of by directing the Inspector-in-Charge, Dum Dum Police Station and Inspector-in-Charge, Nagerbazar Police Station, being the respondent Nos.4 and 5 herein to keep a strict vigil at the locality where the two stores of the petitioners/company are located and to ensure that there is no breach of peace in an around the aforesaid stores. The respondent/police authorities are also directed to take appropriate steps against the persons, who may create any obstruction at

the entry and exit points of the delivery personnel of the said stores of the petitioners/company. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
