02/21.04.2026 Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioners are apprehending their arrest in connection Nirsa P.S. Case No.217 of 2021 registered for the offences under Sections 147, 148, 149, 353, 379, 186, 413, 414, 420 of the IPC, & Sections 4/21 of MMDR Act & Rule 4/54 of JMMC Rules & 13 of JM(PIMTS) Rules, pending in the court of, learned Judicial Magistrate, 1st Class, Dhanbad.

Learned counsel appearing for the petitioners submits that the allegations are made that sand has been stored in a particular place to the tune of 02 lakh Cft. He then submits that there are 31 named accused and the name of the petitioners has been taken by the co-villagers. He also submits that even the person, who has taken the name of the petitioners, his name has not been disclosed in the FIR. He also submits that the co-accused persons have already been granted anticipatory bail in ABA No.3380 of 2023, ABA No.7002 of 2024 and ABA No.6448 of 2025.

Learned counsel appearing for the State has opposed the prayer and submits that the sand was stored in a particular place.

In view of the above and considering that the co-accused persons have been granted anticipatory bail in aforesaid A.B.As. and the person who has taken the name of the petitioners, his name has not been disclosed in the FIR, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the petitioners, above named are directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-

Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad, in connection with Nirsa P.S. Case No.217 of 2021, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita,

7. This Anticipatory Bail Application is accordingly allowed and
disposed of.
