Learned advocate appearing for the petitioner submits that the petitioner was subsequently tagged in the instant case and from him there has been recovery of 25 grams of Yaba tablets. Petitioner is in custody for more than eight months. Although charge-sheet has been submitted, but there is no scope of the trial commencing very soon as three of the accused persons are absconding. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the subject-matter of the case relates to 2880 bottles of Wincerex cough syrup and Yaba tablets. Petitioner was in communication with the principal accused and after his
2 arrest there has been recovery. Petitioner is not similarly situated as other accused persons. Having regard to the complicity of the present petitioner, I am not inclined to release the petitioner on bail at this stage. As such, the prayer for bail of the petitioner is rejected. However, the learned Trial Court, if required, would split up the trial and proceed with the trial of the case. Petitioner would be at liberty to approach this Court after the evidence of the seizure list witnesses is over. The application for bail, being CRM (NDPS) 575 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
