GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following order: The petitioner is aggrieved by the inaction on the part of respondent No. 4 in removing of the logging drain public cesspool from Depot No. 1 of APSRTC, Nellore, into the Government Irrigation Channel (Kanuparthipadu Irrigation Channel) running across the railway line Nellore. He submitted that the 4th respondent is letting out the entire drainage water and effluents from the bus station into the government irrigation channel. It is submitted that the drainage channel has lost its function and collapsed at many places and on account of it the drain is overflowing making it impossible for the residents nearby to reside. In this regard the petitioner made several representations to respondent Nos. 2 to 4 seeking their indulgence to remove the logging drain and ensure free flow of the drain water. It is submitted that the 3rd respondent is also under statutory obligation to ensure the drains are maintained properly and not cause inconvenience to the residents nearby. It is submitted that the inaction on the part of respondent Nos. 2 to 4 is causing inconvenience to the petitioner. 2. The learned Standing Counsel appearing for respondent No. 3 submits that the representation of the petitioner shall be considered in accordance with law. 3. Recording the submissions made, the writ petition can be disposed of directing respondents 2 to 4 to ensure that the drains are maintained properly and the third respondent shall have to take up immediate steps for repairing the drains and also ensure no overflowing of the drainage water on to the roads. It is also the responsibility of respondent No. 4 to ensure that the drain water is not let out on to the public roads causing inconvenience. Adequate steps would have to be taken by respondent 2 to 4 and ensure that the government irrigation channel is maintained appropriately for ensuring free flow of water without stagnation or overflowing. At any rate respondents 2 to 4 shall have to comply with this order within a period of 8 (eight) weeks from the date of receipt of this order. 4. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
