2. Ms. Rangoli Purohit, learned AGA, for the State of Uttarakhand.

The present applicant – Gurmeet S/o Shri Pritam Singh, is praying for bail in a reference to FIR dated 10.03.2026 bearing FIR No.243 of 2026, Police Station Kotwali Laksar, District Haridwar, in which as many as four persons, namely, Vishal, Kartik, Gurmeet and Akshay, have been implicated for the offences punishable under Sections 109, 190, 191 (2), 191 (3), 332 (a), 333, 351 (2) and 352 of BNS, 2023, wherein, on culmination of the investigation in total five persons were chargesheeted, including the present applicant.
4. It is argued by the learned counsel for the applicant that the present applicant is innocent and has been falsely implicated, and there is no recovery from the present applicant. He further submits that other co-accused, namely, Vishal was granted interim bail by this Court on 17.04.2026 in ABA No.123 of 2026 and the other co-accused, namely, Akshay Kumar, have already been enlarged on bail by the coordinate Bench on 30.05.2026 in BA 1st No.773 of 2026, and claims parity of co-accused – Akshay Kumar. He also submits that the applicant has no previous criminal antecedents.
5. On the other side, learned AGA submits that after collecting all credible evidence, the chargesheet has been filed, however, she has not disputed that the applicant has no criminal
antecedents and also apprised to this Court that as per prosecution the main accused is Salim, from whose possession the Tamancha was recovered.
6. After hearing the rival submissions of the
learned counsel for the parties, and taking into
consideration that the applicant has no criminal antecedents and it is a case of no injury and furthermore the other co-accused, namely, Akshay Kumar, has been enlarged on bail by the coordinate Bench of this Court on 30.05.2026 and other co-accused, namely, Vishal, has been granted interim bail in ABA No.123 of 2026, and the recovery as shown by the prosecution is from Salim, this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merits of the case, the bail application is allowed.
8. Let the applicant – Gurmeet, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned with the following conditions:- (a) It is made clear that after being released on bail, the applicant shall join the Trial Court proceedings on each and every date without seeking any adjournment. (b) He shall not make any attempt to give any threat to the victim and family members. (c) In default of any one of the conditions, the prosecution is free to move an application for cancellation of the bail.
