THIS PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT BY ISSUANCE OF WRIT IN THE NATURE OF MANDAMUS OR ANY OTHER APPROPRIATE WRIT, DIRECTING THE OFFICIAL RESPONDENTS, INCLUDING THE GREATER BENGALURU AUTHORITY, THE BENGALURU WEST CITY CORPORATION AUTHORITIES AND THE BANGALORE METROPOLITAN TASK FORCE, TO FORTHWITH CONDUCT A SPOT INSPECTION OF THE SCHEDULE PROPERTY BEARING NO.97, SITUATED AT RAVI, YESHWANTHPUR HOBLI, BENGALURU NORTH TALUK, MEASURING 30 FEET X 40 FEET (1200 SQ. FT.), AND TO IMMEDIATELY STOP AND PREVENT ALL UNAUTHORISED CONSTRUCTION ACTIVITY BEING CARRIED ON THEREIN, AS BROUGHT TO THE NOTICE OF THE OFFICIAL RESPONDENTS UNDER THE PETITIONER'S REPRESENTATION DATED 10/02/2026 (ANNEXURE-F) AND THE LEGAL NOTICE DATED 13/02/2026 (ANNEXURE-G) AND ETC.

ORAL ORDER
1. The writ petition is filed with the following prayers: a. Direct by issuance of Writ in the nature of Mandamus or any other appropriate Writ, directing the official respondents, including the Greater Bengaluru Authority, the Bengaluru West City Corporation authorities and the Bangalore Metropolitan Task Force, to forthwith conduct a spot inspection of the schedule property bearing No.97, situated at Ravi, Yeshwanthpur Hobli, Bengaluru North Taluk, measuring 30 feet x 40 feet (1200 sq. ft.), and to

immediately stop and prevent all unauthorised construction activity being carried on therein, as brought to the notice of the official respondents under the petitioner's representation dated 10/02/2026 (Annexure-F) and the legal notice dated 13/02/2026 (Annexure-G);
b. directing the official respondents to initiate and complete statutory proceedings in accordance with law against the persons responsible for the unauthorised construction, including issuance of stop work notice, sealing and/or removal and/or demolition of the unauthorised structures, and to take all consequential coercive steps to protect the schedule property and prevent further illegal interference, in the light of the photographs evidencing ongoing illegal construction (Annexure-K to k5 series);
c. directing the official respondents, including the Bangalore Metropolitan Task Force, to provide necessary enforcement assistance and protection to ensure effective implementation of the statutory action and to prevent the private respondents and all persons claiming through them from continuing trespass, construction, or creation of any third-party interest in the schedule property.
d. Pass such other and further reliefs as this Honourable Court may deem fit and proper, including an award of costs, in the interest of justice and equity."

Learned counsel for respondents-Greater Bengaluru Authority (GBA) has filed a memo of compliance, wherein inspection report of the property has been enclosed.

Learned counsel for GBA upon instructions, submits that, respondent no.8 has obtained a plan sanction to put up construction on the property which is the subject matter of the writ petition. However, so far only foundation has been laid and pillars are under construction. There is no building constructed yet on the property. He further submits there is violation of building bye-laws in so far as it relates to erection of the pillars concerned and if respondent no.8 does not modify the same and puts up construction in violation of the sanctioned plan, action would be initiated against respondent no.8 to have the same removed.

Learned counsel for respondent no.8 submits that, he will be putting up construction only in accordance with the sanctioned plan and not otherwise. He further submits that, he has obtained the sanctioned plan.

Learned counsel for the petitioner submits that the property belongs to her and respondent no.8 has no authority to put up construction on the property.
6. No person has a right to put up construction in violation of building bye-laws and the sanctioned plan. If any such construction is put up, then the building is liable to be demolished by the authorities concerned.
7. However, in respect of title dispute, in these proceedings the same cannot be adjudicated when the writ is filed for initiating legal action against the property concerned and the parties are at liberty to work out their remedy before the Civil Court in accordance with law.
8. Hence, the following:
ORDER i. Construction on the property which is the subject matter of the writ petition will be strictly be put up in accordance with the sanctioned plan and if any deviation is found,

respondents-GBA shall have the same demolished in the manner known to law; ii. Writ petition stands disposed of accordingly.
