The instant application has been preferred by the applicant prayed for stay of the impugned Judgment and Order dated 04.02.2025 passed by the learned Member, Motor Accident Claims Tribunal No.3, Kamrup (M), Guwahati, in MAC Case No. 2116/2020 pending disposal of the MAC Appeal. 3. Ms. R.D. Mozumdar, learned counsel for the appellant submits that the MAC appeal filed against the Judgment and Order dated 04.02.2025 has been admitted by this Court and it is also further submits that the appellant has taken good grounds and which are likely to succeed and therefore it is prayed that the impugned Judgment and Order dated 04.02.2025 be suspended during the pendency of the MAC Appeal. 4. This Court have considered the submissions of the learned counsels and the pleadings in the application. And as such the impugned Judgment and Order dated 04.02.2025 passed by the learned Member, Motor Accident Claims Page No.# 4/4 Tribunal No.3, Kamrup (M), Guwahati, in MAC Case No. 2116/2020 shall remain suspended during the pendency of the appeal subject to the condition that the appellant shall deposit the 50% of the awarded amount before the Registry of this Court within a period of 6 (six) weeks. 5.
