Records reflect that the Division Bench in CRM(NDPS) 1314 of 2022 by an order dated 21.02.2023 was pleased to reject the prayer for bail of the petitioner on perusal of the chemical examiner’s report. Be it mentioned that there was categorical observation of the Division Bench that the interim bail is not confirmed. Petitioner submits that the petitioner was attending the court but was never taken into custody but all on a sudden he was taken into custody in August, 2025 and since then he is behind the bars. Learned advocate for the State submits that commercial quantity of contraband was seized from the possession of the petitioner. Witness action has commenced. It has been submitted 2 that out of 7 witnesses proposed, 2 witnesses have been examined. Be that as it may, learned trial court would expedite the process of examination of the witnesses. Having regard to the materials appearing against the present petitioner, I am not inclined to release the petitioner on bail. Accordingly, CRM(NDPS) 45 of 2026 is dismissed.
