Petitioners have filed this writ petition seeking following reliefs. “10.1 This Hon’ble Court may kindly be pleased to quash/ set aside the impugned promotion order dated 17.10.2025 (Annexure 3 / 4 P-1) issued by the District Education Officer, ie., Respondent No. 3. 10.2 This Hon’ble Court may kindly be pleased to quash/ set aside the gradation list dated 10.02.2025 (Annexure P-9). 10.3 This Hon’ble Court may kindly be pleased to direct the respondent authorities to specially respondent No. 3 to consider the case of petitioners for promotion with all consequential benefit from the date juniors have been promoted. 10.4 That the Hon’ble Court may further pleased to grant such other relief as may be deemed fit and proper in the interest of justice.” 2. Learned counsel for petitioners submits that petitioners were initially appointed as Class-IV employees on the post of Peon on temporary basis. Their services were regularized on 08.09.2008 under the policy of the State Government dated 05.03.2008. Since the date of initial appointment, petitioners have continuously worked as Class-IV employees. Petitioners after completion of requisite period of service became eligible for the post of Assistant Grade-III considering their candidature. However, petitioners were not promoted but many of the juniors to the petitioner have been promoted to the post of Assistant Gr. III. Petitioners through their union have submitted representation before Respondents No. 1 to 3, however, no decision has been taken. 3. Learned State counsel submits that petitioners have not submitted their representation separately, if petitioners want promotion for themselves then they need to submit representation in individual capacity. 4. On due consideration of the facts and circumstances of the case, submission made by learned counsel for respective parties, this writ petition at this stage is dispose off, permitting the petitioners to submit fresh comprehensive representation before Respondent No. 3/ District 4 / 4 Education Officer, raising all the grounds and if such a representation is submitted, the concerned authority shall consider and take decision on the representation to be submitted by petitioners, in accordance with law, expeditiously, preferably within a further period of 03 months from the date of receipt of representation. 5.
