JUSTICE PRAVEER BHATNAGAR Order 22/05/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 40/2026 registered at Police Station Karnivihar, District Jaipur (West) for the offences under Section 115(2), 126(2) and 189(2) of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is argued that petitioner and complainant have arrived at an amicable settlement and the compromise was executed on 12.05.2026. The injuries sustained to the injured is not found to be dangerous to life, the accused-petitioner is in custody since long and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. Learned counsel appearing on behalf of the complainant/victim concedes that complainant and petitioner have entered into a compromise and the complainant has no objection if the bail application of the petitioner is allowed. 5. Heard and perused the material available on record. 6. Considering the arguments advanced by learned counsel for the parties and looking to the fact that petitioner and complainant have amicably settled their dispute and if the bail application of the accused-petitioner is allowed then complainant has no objection. The accused-petitioner is in custody since long and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 7. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Sitaram Sharma @ Radhe Sharma S/o Shri Rameshwar Prasad Sharma, in connection with FIR No. 40/2026 registered at Police Station Karnivihar, District Jaipur (West) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
