And the entire records from the 1st Respondent in related to the approval order dated 26-09-2022 vide No. ED67DTE2022 and the entire records from the Principal of the 8th respondent college in related to the Circular dated 21-01-2025, 21-02-2025 & 12-03-2025 vide No. NIE/PPL/100/2024-25 and the entire records from the 5th respondent relating to Voluntary Separation Scheme (VRS)-25 dated 07-04-2025. b) Issue an order or writ of certiorari or any other appropriate writ and quash the No Objection Certificate dated 21-04-2022 vide No.VTU/BGM/Aca/2022-23/551 issued by the 9th respondent Visvesvaraya Technological University, Belagavi as per Annexure-X. Further declare that same is issued without there being any decision of the 5th respondent Trust or its consent without considering the rights and welfare of the Teaching and non-Teaching its permanent staffs. c) Issue an order or writ of certiorari or any other appropriate writ and quash the closure of institution order 04-07-2022 vide No. F. No. South-West/1- 10972986377/2022/Closure of Institution-Merger passed by the 4th respondent AICTE, New Delhi as per Annexure-AA. And Extension of the Approval order - 33 - HC-KAR NC: 2026:KHC:17877 WP No. 15311 of 2025 C/W WP No. 15270 of 2025 WP No. 15326 of 2025 dated 11-07-2022 vide F. No. South-West/1- 10970066278/2022/EOA passed by the 4th Respondent AICTE, New Delhi as per Annexure-AB. Consequently, declare that same is passed contrary to the AICTE Regulations and its Handbook issued for the year 2022- 23 without notifying it to the general public and without the consent of the 5th Respondent Trust and same was issued based on the unilateral decision of the 7th respondent Society. d) Issue an order or writ of certiorari or any other appropriate writ and quash the order dated 26-09-2022 Vide No. ED67DTE2022 passed by the 1st respondent Principal Secretary, Department of Higher Education (Technical Education), Govt. of Karnataka, Bengaluru as per Annexure-AE. Consequently, declare that same is illegal & arbitrary, same is passed contrary to the prevailing law and back behind the petitioners, same is not in terms of Karnataka Education Act, 1983 and its Rules. e) Issue an order or writ of certiorari or any other appropriate writ and quash the Circulars dated 21-01- 2025 vide No. NIE/PPL/100/2024-25 as per Annexure- BX, 21-02-2025 vide No. NIE/PPL/100/2024-25 as per Annexure- BY and 12-03-2025 vide No. NIE/PPL/100/2024-25 as per Annexure-CB issued by the Principal of 8th Respondent The National Institute of - 34 - HC-KAR NC: 2026:KHC:17877 WP No. 15311 of 2025 C/W WP No. 15270 of 2025 WP No. 15326 of 2025 Engineering, Mysuru. Consequently, declare that same are issued without the source of powers and authority under the scheme of the Karnataka Education Act, 1983 and AICTE Regulations. f) Issue an order or writ of certiorari or any other appropriate writ and quash the Voluntary Separation Scheme, (VRS)-25 for teaching and non-teaching staffs of the 6th respondent NIE Institute of Technology, Mysuru promulgated by the Honorary President, Honorary Secretary and Honorary Treasurer of NIE Institute of Technology, the 5th respondent as per Annexure-CL. Consequently, declare that same is promulgated without any source of powers and the prior approval of the appropriate authority under the scheme of Karnataka Education Act, 1983 and AICTE Regulations more particularly without taking leave of the jurisdictional Civil Court U/s 92 of CPC 1908, being a public Trust. g) Issue an order or writ of mandamus and direct the 1st respondent Principal Secretary, Department of Higher Education (Technical Education), Govt. of Karnataka, Bengaluru and the 4th respondent Chairman/Director of All India Council for Technical Education, New Delhi (AICTE) and The Registrar /Hon'ble Vice Chancellor of the 9th respondent Visveswaraya Technological University, Belagavi to - 35 - HC-KAR NC: 2026:KHC:17877 WP No. 15311 of 2025 C/W WP No. 15270 of 2025 WP No. 15326 of 2025 consider the petitioners' representation dated 13-03- 2025 as per Annexure-CC, CD & CE respectively. h) Pass any appropriate writ, order or direction as this Hon'ble Court deems it fit and proper in the facts and circumstances of the case and allow this Writ Petition with costs, in the ends of justice and equity." 4. After arguing the matter for sometime learned counsel for the petitioner submits that respondent No.6-Institution had issued notices styled as “Notice regarding progressive closure of NIE-IT and retrenchment of employees with effect from 11.06.2025” to which the petitioners had submitted detailed replies dated 19.06.2025 ventilating their grievances. 5. It is submitted that since respondent No.6 has not passed any orders/taken any decision pursuant to the reply submitted by the petitioners in all the petitions, all the petitioners may be disposed of directing respondent No.6 to consider the reply submitted by the petitioners and pass appropriate order/take appropriate decision within a stipulated time frame and by reserving liberty in favour of the petitioners to approach this Court subsequently in relation to the remaining prayers sought for in the petition. - 36 - HC-KAR NC: 2026:KHC:17877 WP No. 15311 of 2025 C/W WP No. 15270 of 2025 WP No. 15326 of 2025 6. Per Contra learned Senior Counsel for respondent Nos.5 to 8 on instruction submits that they have no objection for respondent No. 6 to consider the replies dated 19.06.2025 submitted by the petitioners and take appropriate decisions/pass appropriate orders in accordance with law. 7. In view of the aforesaid facts and circumstances and joint submissions made by both sides, though several contentions have been urged by both sides in support of their respective claims, without expressing any opinion on the merits/demerits of the rival contentions and/or remaining relief sought for by the petitioner in the present petition, and by keeping the same open, I deem it just and appropriate to dispose of all the petitions directing the respondent No.6 to consider and pass appropriate order/take appropriate decision pursuant to the replies dated 19.06.2025 submitted by the petitioners and in accordance with law within a period of one month from the date of receipt of a copy of this order. 8. It is further directed that any amount paid by respondents to the petitioners prior to the present petition would be without prejudice to the rival contentions. Liberty is also reserved in favour of the petitioners to seek recourse to such remedies as - 37 - HC-KAR NC: 2026:KHC:17877 WP No. 15311 of 2025 C/W WP No. 15270 of 2025 WP No. 15326 of 2025 available in law including approaching this Court subsequently in relation to the remaining prayers sought for by the petitioners.
