The petitioner is apprehending his arrest in connection with Gumla P.S Case No. 239 of 2025 for the alleged offences registered under Sections 27 (b) (ii) of Drugs& Cosmetics Act, 1940 and under Sections 21 (c )/22(c ) of NDPS Act, 1985 pending in the Court of learned Sessions Judge, Gumla. 3. Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the confessional statement of co- accused. Recovery of Win Corex Cough Syrup and Winpasmo Forte Capsule has not been made from the possession of the petitioner, and in view of that the anticipatory bail application of the petitioner may kindly be allowed. 4. Learned counsel for the State opposes the bail application of ( 2026:JHHC:11646 ) --2-- the petitioner and submits that 25,290 winspasmo Fort Capsule containing in five carton and 100ml of 2950 bottles of Cough Syrup were recovered, which is of commercial quantity, and in view of that the anticipatory bail application of the petitioner may be rejected. 5. It has come that with the help of the petitioner the sale of the said cough syrup was being made, and the said recovery is in commercial quantity, in the attending facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, and hence, the prayer for anticipatory bail of the petitioner, is hereby, rejected. 21.04.2026 (Sanjay Kumar Dwivedi, J.)
