Apprehending arrest, the applicant has approached this Court in connection with Crime No.211/2026 for the offences punishable under Sections 74, 118(1), 115(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, registered with Police Station Andhera, District Buldhana. 3. As per the First Information Report (F.I.R.), the informant alleged that on 12/06/2026 at about 09:30 a.m., the accused persons namely, Rajratan Jadhao has assaulted the informant using a stone resulting the head injury, further he has slapped the informant and has given fist blows on the back of the informant. It was further alleged that the accused person threatened to cause harm to the lives of the informant and his Piyush Mahajan 2026:BHC-NAG:12021
2 11-Cr.ABA-809-2026 family members. The informant was thereafter taken for medical treatment. Based on these allegations, the First Information Report (F.I.R.) came to be registered on 16/06/2026. 4. The learned counsel for the applicant submits that the First Information Report was a counterblast to the offence which was registered by the present applicant. He submits that the allegations contained in the F.I.R. are concocted and imaginary since no such incident took place. He further submits that, so far as the present applicant is concerned, he was at Noida at the time of the incident, where he was working in the company and his attendance sheet has been placed before the trial Court to substantiate his presence. However, the informant has continued to implicate his name in the case. He further submits that this fact itself shows that the allegations made against the applicant are with an ulterior motive, and therefore, he submits that the applicant deserves to be granted bail. 5. On the other hand, the learned A.P.P. vehemently opposes the application and submits that the applicant is actively involved in the commission of the offence. She further submits that the applicant had initially demanded money from the informant for the purpose of consuming liquor.
When the informant declined his demand, the applicant, with the help of a stone, gave a forceful blow on the head of the informant, due to Piyush Mahajan
3 11-Cr.ABA-809-2026 which the informant fell down and has lost his consciousness. Thereafter, the applicant has followed the informant and further he has assaulted him by giving fist blows. When the informant reached his house, the applicant followed him and, thereafter, the applicant has also assaulted the informant’s mother with the help of a wooden stick and further he has abused the wife of the informant in a filthy language by stating that the applicant would undress her on the road. She further submits that the injuries caused to the informant are serious in nature, and also there is a fracture to the bilateral nasal bone and nasal septum, along with other injuries, and therefore, the learned A.P.P. submits that this is not a fit case to grant anticipatory bail to the applicant. 6. Upon consideration of the rival submissions, it appears that the incident took place on 12.06.2026 in the morning at about 09:30 a.m. It further appears that the applicant has demanded money for consumption of liquor, however, when the informant declined to give the money, the applicant, with the help of a stone, gave blows on the head of the informant, due to which blood was oozing and the informant fell down and lost his consciousness. Thereafter, when he regained his consciousness, the applicant followed him to his house and further assaulted him. When the informant reached his house, the applicant has assaulted the mother of the informant. It further appears that the applicant has also abused the wife of the informant in a filthy language and has threatened her that Piyush Mahajan

Upon consideration of the allegations contained in the F.I.R., it appears that the allegations are serious in nature further they are supported by the medical report, which could be gathered from the observations of the learned Additional Sessions Judge, Buldhana, wherein it was observed that the medical case record, particularly the CT scan report goes to show that due to the assault, the informant has sustained fracture to the bilateral nasal bone and nasal septum, along with other injuries. Under such circumstances, I am not inclined to grant bail to the applicant. Hence, the Criminal Application is rejected. [ (M.M. NERLIKAR, J.)
