Heard learned counsel appearing for the petitioners and learned counsel appearing for the State. 2. The petitioners are apprehending their arrest in connection with Complaint Case No. 1218 of 2018, registered for the offence under Section 33 of the Indian Forest Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Chatra. 3. Learned counsel appearing for the petitioners submits that the the petitioners have been falsely implicated in this case alleging that they have constructed the house on the forest land. He submits that Neutral Citation No. ( 2026:JHHC:12430 ) the petitioners are residing in their ancestral house and the land is of raiyati nature which is adjacent to the forest land. On these grounds he submits that petitioners may be granted anticipatory bail. 4. Learned counsel appearing for the State opposes the prayer and submits that in the offence report it has come that the petitioners have constructed the house in the forest land and also been cultivating the said land. 5. Considering that there is land dispute and the petitioners are having no criminal antecedent which is disclosed at para 18 of this petition. It has further been pointed out that the petitioners are having the raiyati land adjacent to the forest. 6. In the attending fact that and in that view of the matter, the petitioners are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms, conditions or sureties as the learned Court may deem fit and proper. 7.
